Gyanvapi: Varanasi court to rule today on maintainability of suits

The Varanasi District and Sessions Court will pronounce its verdict on Monday on the sustainability of civil cases challenging the title of the Gyanvapi Masjid and its surrounding land.

The petition was filed by five Hindu women seeking the right to worship Maa Shringar Gauri on the outer wall of the mosque complex, located next to the Kashi Vishwanath temple.

On 20 May, the Supreme Court transferred the Gyanvapi dispute before the Civil Judge (Senior Division), Varanasi, to the District Judge, Varanasi, underlining the “complexity of issues involved in the civil litigation”.

While the Hindu side contended that the mosque was built on the site of a temple, the Muslim side argued that the mosque was built in the waqf complex, and the Places of Worship Act prohibited changing the character of the mosque.

District Judge AK Vishvesh began hearing the petitions in June.

The media was not allowed to watch the proceedings.

In July, the Supreme Court said it would wait for the Varanasi district court’s decision on the mosque committee’s application, objecting to the sustainability of a civil suit filed by Hindu devotees, before intervening in the matter.

A bench of Justices DY Chandrachud, Surya Kant, and PS Narasimha adjourned the matter till October 20.

The bench said that all the issues will have to be debated first in the district court. Anjuman Intezamiya was challenging the survey of the Gyanvapi complex in Varanasi where a Shivling was found.
