Supreme Court to hear in October first week pleas on Gyanvapi mosque
New Delhi: The Supreme Court on Thursday said it will wait for the Varanasi district judge’s decision on the application of the Gyanvapi Masjid Committee objecting to the hearing of a civil suit filed by Hindu devotees.
A bench of Justices DY Chandrachud, Surya Kant and PS Narasimha asked for the first week of October to hear the plea of the Gyanvapi Masjid Committee against the Allahabad High Court order upholding the appointment of a Court Commissioner to survey the site.
The bench said that it has been apprised of the fact that the proceedings are still on before the District Judge and it would be appropriate that the appeal of the Masjid Committee be kept pending till the outcome of the application filed under Order 7 Rule 11, wherein questioning the maintainability of the suit.
On May 20, the top court transferred the civil suit filed by Hindu devotees on the Gyanvapi mosque from the civil judge (senior division) to the district judge, Varanasi, saying that given the “complexities” and “sensitivity” of the issue, It is better if a senior judicial officer having more than 25-30 years of experience handles the matter.
