FCRA: Supreme Court to consider a petition against cancellation of NGO’s registration

The Supreme Court on Friday said it would examine the matter arising out of a petition filed by the Union Home Ministry challenging the cancellation/non-renewal of registration of NGOs under the Foreign Contribution (Regulation) Act, 2010. The question is whether or not it is included in its April 2022 decision. It upholds the amendment to the Act.

A bench headed by Justice KM Joseph said it would look into it. However, the petitioner and the Center maintained that the issues were covered in the April 8 judgment in Noel Harper & Ors vs Union of India case.

Senior advocate Sanjay Hegde, appearing for the petitioner NGO Global Peace Initiative, submitted that most of the issues were considered in Noel Harper’s decision and that the court would settle it by giving him the freedom to represent the ancillary issues before the government. I can do it after modification.

The bench, also comprising Justice Hrishikesh Roy, said it would examine whether the ruling covered the questions and posted it for hearing on November 21.
