SC asks HC to submit details of criminal cases against MPs and MLAs pending for more than five years

The Supreme Court on Monday asked high courts across the country to inform them about felonious cases involving further than five times against members of congress and members of the houses on affidavits in four weeks.

A bench of judges DY Chandrachud and Hima Kohli, which was hearing a PIL seeking a ban on the querying of the condemned MLAs, also asked the high courts to point out that the trial in these cases should be expedited.

On the request of the amicus curiae’s elderly advocate Vijay Hansaria, the court also modified its August 2021 order, which said that special courts CBI courts dealing with cases against MPs and MLAs should be reserved for judicial officers presiding. Its last blessing was necessary for transfer.

Hansaria said that several high courts had applied for revision of the order, and the Chief Justice concerned could look into the question of his transfer.

The bench still said that the previous blessing demand would remain in force if the transfer doesn’t do in the regular order of transfer and advertisement.

The elderly counsel had also suggested that the SC seek a report from the HC on pending matters more than five times, to which the bench agreed.

Hearing PILs, the Supreme Court has, in history, constituted special courts to try cases against MPs and MLAs and has been covering the perpetration of its directions from time to time.
