IRCTC scam: Delhi court turns down CBI’s plea to cancel Tejashwi’s bail; Asked the RJD leader to ‘take caution’
A Delhi court on Tuesday refused to cancel the bail granted to Bihar Deputy Chief Minister Tejashwi Yadav on a plea by the Central Bureau of Investigation (CBI) in the IRCTC hotels contract case, saying there was no specific ground to cancel the relief to him.
Dismissing the CBI’s plea, Special Judge Gitanjali Goel, however, asked the Rashtriya Janata Dal (RJD) leader to “be careful” and avoid “unjustified criticism” of the agency.
The CBI had applied for cancellation of bail before a particular judge at Rouse Avenue Court, arguing that the accused [Tejashwi] had attempted to portray the agency in a bad light, saying that “it was a matter of political parties”. The court observed that Tejashwi’s statements were “irresponsible” but could not be construed as a threat when read in light of what was said before the referenced parts of the words.
The court also agreed with Tejashwi’s counsel, senior advocate Maninder Singh, that “reasonable remedies were available with the CBI in this regard such as defamation, or if the authorities were threatened to register an FIR which was not done”.
Advocate DP Singh, appearing for CBI, submitted that the said: “statements do not pertain to only one case, but are part of the larger design of the accused and are not only reprehensible but also a clear attempt to prevent the trial from reaching the trial”.
Tejashwi’s counsel argued that a rumour was spread during the CBI raids on August 24 that his client owned a mall in Gurgaon. “Tejashwi addressed a press conference to clarify that he has no mall in Gurugram,” the lawyer said, adding that his (Tejashwi’s) statements were misinterpreted and he did not threaten CBI officials. The court had granted bail to Tejashwi in October 2018, when he appeared in pursuance of a summons issued against him in a case related to alleged irregularities in the award of operating contracts of two Indian Railway Catering and Tourism Corporation (IRCTC) hotels to a private firm.
